Las medidas precautorias son un instrumento de impartición de justicia que ayuda a aplicar de acuerdo al derecho la ejecución eficaz y completa de una sentencia o laudo arbitral. El viejo debate sobre el régimen de distribución de competencia entre árbitros y jueces en materia de impugnaciones al acuerdo arbitral, (entre ellas la relacionada con la facultad de dictar medidas precautorias), se encuentra superado como consecuencia de la celebración de un convenio arbitral, el o los litigios que éste abarca ya no serán resueltos por los tribunales oficiales de ningún Estado sino por un tribunal arbitral. Así las partes, por su propia voluntad, excluyen la competencia judicial. |
